If you were a student on F1, and if you just got an OPT (Employment Authorization), you do not have to pay Social Security tax. Once you switch to H1, you have to pay the SS tax.

I have realised that all Legal Immigration hopes ,in this country of dreams, are futile and there are better things in life than just to wait / hope for a change.

What are those little green squares that show up with our names when we post something?? When you hover over them you see a ToolTip message.
Are they supposed to tell us if we've been Naughty or Nice this year? :cool:
They represent reputation points.Everyone will have one at starting.As people start to add you the reputation points..The green squares will increase.Sometimes they depend on number of posts you posted in the forum.

I travelled on mine 3 months after it was issued ( delay in getting wife's visa). I was questioned at the airport about the delay in travel. Explained the delay and got entry. It may be possible that they may like to speak to your immediate boss (carry his office and cell numbers)

Letter from me stating I will support her and that she will live with me in US
My bank statements (last 3 months)

Hi,
I filed my 485 in Dec 2004.My PD is June 2004.
Got married in 2005.
If (Less Probability..) i get my 485 approved and not able to add my Spouse's to my 485.
What would be my Options.
Please advice.

Given the success coming out of Phase I, there is tremendous potential for a big change in the green card process by implementing Phase II
Other state chapter members who are in the midst of planning for Phase II are also welcome to join. But you have to belong to a state chapter in order to participate

Since EB-1 does not need labor certification, the process is completely independent of EB-2. As such you cannot "port" your EB-2 application the way people transition from EB-3 to EB-2. You will have to apply directly to USCIS with evidence of your "extraordinary ability" in your field, such as honorable membership of professional bodies, research track record, letters from well-known people in your field etc. The first stepto convince USCIS about exceptional ability is very involved, but there on I-140 and I-485 should proceed far more smoothly than EB-2.

I was on H1 status but got laid off. I have my EAD and my AP has been approved but I have not yet received it in the mail. Once I do, is it safe to travel outside the US and re-enter using AP if i don't have job yet?

In my employer company (NJ based, desi consulting company) about 50% of the EB-2 PERM applications are under audit.
I need to file my application for EB-2 and I called them. (I have a EB-3 approved labor, on which my employer has filed I-140)
The paralegal advised me that they have stopped filing PERM applications since this month March 2008, hoping that there would be change of PERM processing or application change.
Does any one have any info about PERM change process? Please advise. Thanks in advance.

However, they have not issued new forms yet, and on their website it states that the current ones continue to be valid. Their site was down for maintenance around the end of March, however, so perhaps that's what the paralegal was referring to?

Hello Gurus,
I have got my wife passport stamped(H4) until Oct'09 based on my previous H1. I have changed company and got new I-797 for both of us valid till Apr'2010. During her recent visit to India and return to USA, at the port of entry she was issued I-94 till Oct'2009 eventhough her I-797 form my new employer is valid till Feb'2010.
I don't want to ask my wife to cross the broder (@Mexico or @Canada) for the sake of renewing her I-94. I am wondering if I can apply with USCIS for her extension of I-94 till April'2010 for which she has I-797 to support it.

not possible. Many documents in first 2 phases are companies. Its is illegal if employee is involved Labor process in any way.

Hello everyone,
Please help me with your valuable suggestions. My H4 extension was applied with my husband's H1 extension through premium processing. Both were approved within 6 days. I got my courtesy copy of H4 extension but my lawyer never got the original approval notice with the new I-94. So my lawyer applied the form I-824 for a duplicate copy of my approval. But will I get a new I-94 with the duplicate copy? I was planning to travel to India next month. I do have the white I-94 that I got when I entered the country and the green I-94 that I got with last year's extension. Only the I-94 from this year's extension is missing. Can I travel with that? Will I have problems at port of entry when I return back? Will I have any problems stamping my H4 with courtesy copy?
I asked my lawyer to file I-102 for replacing the lost I-94 but he said that form is for replacing the original I-94 I got at port of entry(which I already have). So there is no need of it. Sorry the post is too long. Thanks a lot in advance.

Just got 3 transfer notices from CSC saying applcations transfered to NSC. Applcations reached July23rd at NSC. 140 approved from TSC.
Anybody in similar situation....

I can also see that the LUD on both my and my wife's 485 applications have changed. It happened on 4th feb i guess (that's when i got the notification).
As 'bostonian' mentions this can be a fingerprinting update or may be zipping and archiving of our files for all we know ;) (just kidding)
