ie., one OPT for under-grad

So I doubt if your wife will get another OPT with the new rule but you never know :-)

If you look closely at June 2008's VB, you'll find the following statement:

Demand for numbers, primarily by Citizenship and Immigration Services Offices for adjustment of status cases, is expected to bring the Employment Third preference category very close to the annual numerical limit in June. Such action would only be temporary, however, and a complete recovery of the cut-off dates would occur for October, the first month of the new fiscal year.
In other words, the PD for EB3 ROW will (or should) be back to March 1, 2006 in October??? So very close for you!

If I understand correctly, once the I-140 is approved, the PD is fixed. Make sure you have all the details of your privious I-140.
you can take up new FT and once the new I-140 is approved and if EB2 July is current at that time, you can ask USCIS to apply that PD to your new I-140. Also the new I-140 needs to be with same or similar job duties / description.

Once they get your response, it will be added to your case and delivered to the officer who issued the RFE. He/she will then make a decision on your case. If at that time your PD is not current, your case can not be approved even if it is approvable, but will be sent to on hold, waiting for your PD to be current.

Well, the first thing that I noticed was not the ceiling, but rather the cute little Shetland Sheepdog in the middle of the walkway. Of course, I love dogs (and especially Shelties)... ;)
I think if I stare at the image long enough, I can sometimes see the effect you're talking about, though it's not like that effect jumps out at me. IMHO, this picture is still a good study of geometric forms, whether or not it has issues with optical illusions. :)
Yes, the dog was cute, and kept staring back at me until I took the picture. Unfortunately my mind was set on getting a shot with only a person in the exit at the end of the walkway. As the dog kept looking at me I realized too late that I was blowing a chance at another picture than the one I set out to get. When I finally got is the dog was too far away. :mad:

Hi Guys,
I have recently got married and entered US on AP, I have not used my EAD and started working for the same employer (GC sponsered). My wife is going for H4 Stamping in US consulate in India. Does any one has any experience? Do you see any problem during Stamping.

As long as you have a clean immigration track record (no out of status, continous pay) - your wife should not have any issues in H4 stamping and there may be administrative delays (like PIMS and etc), which no one has control over it.

My Green Card was recently approved. But, due to retrogression I had not filed for my wife's green card.We did file her I-485/EAD/AP during the month of July. My PD is around 2003, and I dont see my wife's GC being approved very soon.
My questions are:
1. What kind of documents are required in the future? Lets say, I start a company and work for my own company. In that scenario, what are the requirements I need to fulfill to keep her application in good standing.
2. What happens if I go without a job for a few months(between consulting gigs). Does this adversely impact her application.
3. At the minimum, how do I keep her application in good standing, and be ready to respond to future RFE's.
I am not sure if these questions were discussed in this forum. I would appreciate if anyone can point me to any links.

We need a handle to kick start a similar plead. In the last one year and quarter here at this forum, I had never seen one that CIS has done injustice to us by mis-interpreting a rule or law or act. If somebody knows otherwise, please state and cite facts. The class action suit ("Schneider vs. Chertoff") was filed by Shusterman on behalf of a group of international doctors in response to CIS regulations implementing the Nursing Relief for Disadvantaged Areas Act of 1999. Section five of the Act provides that "any alien physician" can qualify for a green card through a "National Interest Waiver," provided they practice in a federally designated health professional shortage area. The National Interest Waiver program is intended to accelerate the hiring of international doctors willing to serve in such areas.
In its regulations implementing the Act, the CIS stated that only primary care physicians, not medical specialists such as surgeons or radiologists, could qualify for green cards through a National Interest Waiver. The agency's regulations therefore eliminated the right thousands of international specialist physicians had to petition for green cards through the National Interest Waiver program.

Now, can I take up a job with a different title - say, "Finance Analyst" or "Corporate Finance"? I have been talking to various clients in California that are interested in offering me finance positions.

IV needs volunteers
As the time approaches for heated immigration debate on the Hill, behind the scenes IV activities are also are also going to increase. IV core members have full time jobs and thus we need more hands to share the mission we have all been working on.
This is a request to IV members if they are willing to spare a few hours everyday for some IV's work. This work will involve writing lots of emails (a template will be provided) and making phone calls.
We all are going through a lot of frustration due to the delays in our green card processes and I am sure highly skilled and educated spouses that are on H4 would have more than our share of pain due to not having any work permit. If we could have such volunteers who can devote few hours during the day for IV it would a Big help. With everyone's effort and support we will surely succeed.

It will be subjective of the examining officer...he could choose to deny the 140, issue an RFE or may even just ignore it...

masala_dosa, this is my understanding. once you have applied for EAD, its your responsibility to keep it valid all the time, independent of if you are using the EAD or NOT. You have to appy for renewals before it expires etc. i dont know if it impacts the current gc process or not.
two scenarios:
If you are using EAD for your current job, and if you did not renew ( or alteast file for renew) before it expires you may notbe able to continue the job.
If you are NOT using EAD, but have an EAD on hand you are supposed to keep it valid.
once again - im not an attorney and all above were my understanding.
why dont you talk to your attorney. he/she may have a simple answer for this.
